Conditions of participation online services
1. Scope of application
Rehm Software GmbH (hereinafter referred to as "Rehm") provides qualification and support services for the customer within the framework of contractual agreements. If the services are provided by way of remote maintenance or as an online workshop (hereinafter referred to as online service), the following provisions apply in addition to the GTC of Rehm:
2. Duty to cooperate
- The customer undertakes to provide the technical requirements in accordance with the specifications of Rehm for the use of the remote maintenance software.
- In order to avoid damage, the customer undertakes to make backup copies of the data files and program files affected by the online service before carrying out the online service.
- The remote access applications are exclusively authorization-based, i.e. access must be actively initiated by the customer. The remote access can be tracked and traced by the customer or participant and he has the option to terminate the remote access at any time. The customer or his authorized representative undertakes to be present during the online service.
- During the online service, the customer is responsible for ensuring that no other, non-booked employees are actively or inactively participating in the online service. The disclosure of access data to third parties is prohibited.
3. Confidentiality
Rehm undertakes to keep secret any data and other information disclosed by the customer in connection with the online service, insofar as this is not generally accessible or publicly known data and information, and to use it exclusively for the purpose of performing the online service.
4. Ordering and processing
- The customer commissions Rehm to perform an online service. After the customer has placed the order via the online service, Rehm will initiate the steps required for the execution. If several customers order the online service at the same time and simultaneous processing is not possible, Rehm is entitled to process the requests according to the order in which the order was placed. The customer has no right to immediate or priority execution of the online service.
- Recording/recording of the online service is not permitted by either party.
5. Liability
Status: November 2022
- Rehm is only liable for intent and gross negligence. Any further liability is excluded. Liability is also excluded if the customer has failed to inform Rehm that he has not been able to make back-up copies of his system and project data and that security measures have not been taken as a result.
- Rehm shall not be liable for any damage caused by the customer's failure to observe the instructions of Rehm's employees entrusted with online services.
- The General Terms and Conditions of Rehm and the agreements on data protection (DSGVO) apply.
